Chennai, Dec 20: The Madras High Court today rejected a plea by 16 accused, convicted to 13 years' rigorous imprisonment in the February 1998 Coimbatore serial bomb blast case, to suspend the sentence and release them on bail.
The convicts filed appeals to set aside the order of the special judge hearing the Coimbatore bomb blasts case, convicting and awarding them 13 years' RI. Pending appeal, they filed applications to suspend the sentence and release them on bail.
A division bench comprising Justice D Murugesan and Justice V Periakarrupiah turned down the plea by Shaul Hameed and 15 others.
"Considering the manner in which the occurrence had taken place, the gravity of the offence and the large number of loss of lives and the method adopted, we are not inclined to suspend the sentence and grant bail," the bench said.
Special judge K Uthirapathi had convicted 154 accused and sentenced them to various terms. Of them, 43 accused including founder-leader of the proscribed Al-Umma, S A Basha were awarded the life sentence. The judge had acquitted eight accused including Kerala-based PDP leader Abdul Nasser Madhani.
The bench said in cases involving conviction under Section 302 (murder), it was only in exceptional cases that the benefit of suspension of sentence can be granted.
"From the evidence let in by the prosecution, we are of the considered view that the petitioners had knowledge of the actual act which they proposed to undertake. Hence, prosecution has prima facie established the conspiracy," the bench said.
Fifty-eight people were killed and 215 injured in the blasts coinciding with the visit of BJP leader L K Advani on February 14, 1998. (Agencies)
